Going around a lot is that everybody respects constitutions now, in Africa.

The first lesson and positive element brought to light by the changes in Burkina Faso is the general recognition and respect including by presidents of the constitution.

But some thought suggests that is too facile.  The problem in Burkina Faso is/was that nobody respected the constitution.  President Compaoré’s legislative majority amended the constitution in 2012 to have a Senate.  Elections were held. Popular protests arose.  The Senate was never implemented.  Nobody seemed to care much that the constitution now was missing a major institution.  Then in October 2014 when President Compaoré sought to change the constitution again through his legislative majority, to change the term limits (in some sense a perfectly constitutional move), protesters unconstitutionally destroyed the National Assembly, and army officers unconstitutionally took power.  So where is the great respect for the constitution?

People are respecting the different interpretations they have of their constitutions, while agreeing to ignore their constitutions when nobody respects what the constitution says.  Constitutions of convenience are probably not the best foundation for durable democracy.

Three groups (army, opposition, and ex-majority CDP) are preparing documents for the transition to a return to democracy and constitutionalism.  They are very focused on the nature of the personality of the presidency. Surprisingly bad choice for opposition which agrees with the mantra “strong institutions not strong men.”  I would guess that more time is spent thinking about WHO  than about how to craft institutions.  The discussions among the groups are to take place this week.  There is no roadmap for how to go from current unconstitutional rule to the transitional rule.  All parties are appealing to good will.

Meanwhile, Colonel Zida and the army have issued decrees for a return to work in a pseudo-constitutional setting.  The problem is that state institutions have to continue to function (e.g. municipal government, schools, tax collection) and yet in a legal sense they are not capable of acting since the constitutional was suspended.  It is not clear what happened to the ministers, for example, since ex-President Compaoré officially dissolved his government.

So things are moving long in an orderly way.  Good so far.

D’autre part, nous suggérons des élections locales anticipées couplées aux élections législatives. Ces élections interviendront naturellement après l’élection présidentielle. Une telle option permettra de redonner une nouvelle légitimité à la fois à l’Assemblée nationale et aux conseils de collectivités. Le gain économique que le pays réalisera à travers une telle opération est déjà connu, si on se réfère à l’expérience de 2012. Ainsi, désormais, on aura systématiquement au même moment des élections locales et nationales tous les cinq ans. Le temps que le pays prendrait à organiser successivement trois élections en moins de trois ans s’en trouverait également réduit.Au plan politique, de telles élections seront dans tous les cas nécessaires pour permettre aux citoyens de se réconcilier avec leurs élus nationaux, mais aussi locaux. Au niveau législatif cela va de soi, dans la mesure où l’Assemblée nationale est dissoute.

Je pense que l’heure de chanter les louanges du mouvement 30 octobre est deja passe, et il faut proposer plus que rebaptiser une avenue comme Boulevard des Martyrs du 30 octobre.

Pendant près d’un quart de siècle, on n’a organisé des élections au Burkina Faso que pour le maintien au pouvoir de Monsieur Blaise Compaoré. La période de transition doit permettre de prendre des dispositions pour éviter la répétition des mêmes erreurs. A cette heure de la transition, on a besoin de tout le monde, sans exception, chacun en fonction de sa spécificité à la place qui est la sienne. L’opposition politique, les organisations de la société civile et l’armée doivent avoir la même détermination en mettant en synergie leurs efforts pour atteindre l’objectif ultime d’une transition réussie qui les crédibilise et accrédite la thèse d’un modèle africain de soulèvement populaire ayant permis de barrer la route à la dictature.

Je me permets une autre observation:  Que le SYNADEC vante la démocracie est quelque chose qui ne devrait pas passer sans commentaire.  Sankara, héro pour plusieurs syndicalists,  n’était pas democrate.  Il pensant, il y a 30 ans, que il fallait qu’un petit groupuscule tenait les reins du pouvoir.  Comment les choses ont changé!

Lots of specificity is missing, though the general thrust of the document is clearly in the right direction.

Spécifiquement, le président de la transition qui « ne saurait être une personne des Forces de défense et de sécurité à la retraite », et qui ne doit pas avoir « soutenu le régime déchu, et plus particulièrement le projet de révision de l’article 37 de la Constitution », doit être « de bonne moralité et ne pas être concerné par une instance judiciaire en cours » ; il doit être « reconnu de bonne moralité et ne pas être concerné par une instance judiciaire en cours ». Il doit également « jouir d’une bonne notoriété nationale », « avoir une parfaite connaissance du fonctionnement des institutions

One speech in particular, the famous “Speech of Political Orientation” Discours d’orientation politique, or DOP given on October 2, 1983, is an important policy document. Just before he was killed Sankara referred to the DOP as a major landmark in the history of Burkina Faso, if not the world. He was clearly very proud of the speech, which was apparently written by Valère Somé. The lengthy exposition defines the revolution as defiantly against imperialism the word is used thirty-eight times in the text. Enemies of the revolution are branded with communist vocabulary. The Committees for the Defense of the Revolution, the new state machinery, are identified and exhorted to do their work well, though their powers and responsibilities are not enumerated. The listener unfamiliar with Lenin’s concept of democratic centralism, invoked deliberately by Sankara, would have had little idea of the practical intentions of the junta in terms of governance of the countryside. An interesting part of the speech is the emphasis on self-education and moral self-reform through reading, reflecting a modernization ideology of material prosperity that relies on transformation of the self.  There is no doubt that Sankara’s heart was in the right place. But the DOP speech and others illustrate three features of Sankara’s rule that I find troubling: 1 a readiness to substitute abstraction and jargon when specificity was called for; 2 an impatient and wishful understanding of the world; and 3 a tone of false modesty. For example, in one speech Sankara discussed the state’s nationalization of land. There was no entertaining the prospect that perhaps the regime had little idea of the effects of such a hasty and broad-stroked legal change. In another speech, Sankara derided the formal legal system of Upper Volta, proposing an informal and possibly oral-based people’s justice. But he did not explain how this justice was to be applied without written rules, or how such written rules would not once again quickly become the mechanism by which the powerful evaded the law.

Simeon Oyono Esono, le chef du Conseil de paix et de sécurité de l’Union africaine et ambassadeur de Guinée Équatoriale auprès de la Cédéao qui avait annoncé plus tôt dans l’après-midi que l’Union africaine donnait aux militaires burkinabè 15 jours pour restituer le pouvoir aux civils, faute de quoi elle imposerait des sanctions a ajouté que l’Union africaine était « persuadée que le changement était allé à l’encontre de la démocratie ». « Cependant, a-t-il poursuivi, nous savons que c’est la pression populaire qui a mené à la démission du président. Les forces armées ont profité de ces circonstances pour accéder au pouvoir mais le peuple est à l’origine ».

C’est peut-être bien le bout du tunnel que l’on aperçoit au siège de l’opposition politique, nous indique notre envoyé spécial à Ouagadougou, Frédéric Garat. Le leader de l’opposition, Zéphirin Diabré, vient de déclarer que l’armée était entièrement disposée à se concerter avec les forces vives de la nation – les politiques, les religieux, les chefs coutumiers, les syndicats et autres associations – pour établir un schéma écrit devant conduire à un processus de transition démocratique conforme à la Constitution. En clair, un document pourrait être produit par des juristes, des constitutionnalistes, pour être ensuite soumis aux politiques et à la société civile pour validation de leur part. Aussitôt fait, on pourra revoir qui dirigera le pays jusqu’à des élections libres démocratiques au Burkina Faso, impérativement avant novembre 2015.L’une des sources de notre envoyé spécial indique que des juristes planchent déjà sur un tel document qui pourrait être connu jeudi, date à laquelle doit se tenir un sommet de la Cédéao à Accra sur la crise au Burkina Faso. Le Burkina pourrait alors produire devant la communauté ouest-africaine les fruits de son travail.

(I am just summarizing large volume of Twitter, Facebook and lefaso.net postings. Obviously impossible for me to verify, from San Jose.  But enough multiple confirmations and original footage to suggest accurate.)

Blaise Compaoré had been in power for 27 years, 31 if one counted the four years from 1983-87 when he was part of a foursome that took power in a military coup. Compaoré took full power in 1987 when Thomas Sankara, president and member of the revolutionary council, was killed. Henri Zongo and Jean-Baptiste Lingani, the two other leaders of the foursome, were killed in 1989. Compaoré continued to consolidate and try to legitimate his regime, but in 1998 Norbert Zongo, a journalist and newspaper editor who was a fierce critic of the regime, was brutally murdered. Subsequent demonstrations by civil society forced Compaoré to accept significant reforms. The reforms proved successful, in terms of minimizing threats to Compaoré’s regime. Compared with many other West African countries, relatively more freedom of press, speech, economic freedom, technocratic government, “organized” corruption, increased protection of property and investments, both for domestic and foreign firms, and encouragement of rapid urbanization through competent urban planning were basics of Compaoré regime from 2000-2014.  The regime became a textbook semi-authoritarian democracy, coopting opposition into a broad umbrella party with much contestation and change in leadership everywhere except the president.

Compaoré was term limited by revised constitution of 1991. His political party, the CDP, revised the constitution in 2012, establishing a bicameral Parliament. Compaoré would then control the Senate (through appointment of many Senators, reserved for the president) and thus have a ¾ control of Parliament and thus be able to revise the constitution again to end term limits. Opposition and civil society mobilized strongly against the Senate, and even though elections were held for Senate, it was never sworn in or opened. Compaoré then realized that a deal with another political party, the ADF-RDA , would give him ¾ control of National Assembly. In mid-October, Compaoré’s party announced they would move ahead with constitutional project to end term limits for Compaoré. The CDP announced the vote would be held October 30, 2014. Opposition and civil society mobilized. There were increasingly large demonstrations on October 27, 28 and 29.

On the morning of October 30, demonstrators broke through barricades after army decided not to fire. The National Assembly was ransacked, as were other government buildings and homes of Compaoré loyalists. When demonstrators tried to get to Kosyam, the presidential palace, they were fired upon by element of the RSP (Presidential guard). Compaoré announced he would end efforts to change the constitution. But overnight, army elements decided to withdraw support for Compaoré. Army chief of staff Nobere Traoré declared he was head of state. Later in evening, Lt. Col. Yacouba Zida, of RSP, announced he was head of state. Compaoré again addressed public saying he was still president. In morning demonstrators massed again.

On October 31, Zida consolidated his power and Traoré was either placed under guard or agreed to have Zida be head of state. Zida announced his consolidation of power. Leaders of Balai Citoyen, a civic movement that had been leading youth in the demonstrations, announced they were favorable to a Zida transitional presidency. On October 31 in the afternoon, opposition parties announced that the military should not assume the presidency. Compaoré fled the country (he apparently drove off in a large caravan of SUV and then was transported by helicopter to Yamoussoukro, Cote d’Ivoire). The RSP had to have assisted or enabled his departure. Compaoré loyalists, including the president of the National Assembly, Soungalo Ouattara, who according to the original 1991 constitution would be the head of state, appear to have gone with him. Saturday Nov 1 the opposition again met, and called for a demonstration against military rule, for Sunday Nov 2. Political discourse went back and forth. On Sunday, a large crowd gathered. Speeches were made. Eventually opposition went to meet with Zida. No comment after meeting. “Informed sources” said dialogue would continue on Monday Nov. 3.

Burkina Faso has a population of 16 million people.  Politicians and colonels and civil society leaders are throwing around “le peuple a dit” etc etc. I like Saran Sérémé because she calls them “la foule.”  And that is right. Crowds in Ouagadougou and elites are deciding.  Outside, in the rural areas of Burkina Faso where more than 10 million people live, there is very little influence over events in Ouagadougou.  No matter how much you admire “popular uprisings” and “the masses” and “the will of the people” it is worth remembering this is a tiny minority of the population that is influencing events.

Burkina Faso’s unseemly rush to declare someone as president is a good lesson for civil society groups and opposition parties all over the continent.  As authoritarian rulers are suddenly ousted, the interregnums that follow can be very messy.  Maybe thinking about this in advance, and committing to a consensus approach in first weeks would be a good thing for opposition parties to agree to?  I think activists in Burkina thought there was going to be more time for a transition.  The last few days have been messy indeed.  But there have been very few civilian-on-civilian deaths- just a handful, it seems.   There is no need for a military strongman to appoint himself president.  We’ll see if Colonel Zida will relinquish the title he has assumed, in the next few days, and let civilians run the state.

Just a side note: Burkina Faso’s southwest is well-known to anthropologists for having acephalous societies… people without chiefs.  Sure there is power, and there are leaders.  But all the trappings of chief are not vested in one person.

Moustapha Ould Limam Chafi, l’homme d’affaires mauritanien conseiller spécial du président déchu du Burkina, Blaise Compaoré, est arrivé samedi soir à Abidjan à bord d’un avion spécial.Il arrive à Abidjan sur invitation du chef de l’Etat ivoirien, Alassane Ouattara, qui lui a fourni l’avion spécial de type Falcon à bord duquel il a voyagé.Ould Chafi a été reçu à l’aéroport d’Abidjan par le frère du président ivoirien, Ibrahim Ouattara, ministre des Affaires présidentiels.Avant de quitter Ouagadougou, Ould Chafi a reçu un appel de Isaac Zida, le président de la transition, qui lui a demandé de rester au Burkina mais Chafi a préféré répondre à l’invitation Ouattara.En quittant sa résidence de Ouagadougou, Ould Chafi a été escorté par des militaires burkinabè qui ont assuré sa sécurité jusqu’à son embarquement pour Abidjan.Blaise Compaoré se trouve actuellement à Yamoussoukro, la capitale politique politique de la Côte d’Ivoire, qu’il a regagné vendredi après avoir quitté Ouagadougou où il avait démissionné de la présidence suite à une forte pression populaire.Moustapha Ould Limam Chafi a été la pièce maîtresse dans la libération de plusieurs otages occidentaux détenus dans le Sahel, indique-t-on.

C’est claire, comme l’avait dit l’ancien député de l’opposition Emile Paré, que c’étaient les citoyens ordinaires, surtout une jeunesse marginalisé, qui ont finalement destitué Blaise Compaoré de Kosyam, après ses 27 (ou même 31 !) ans de pouvoir. Et comme l’avait dit Saran Sérémé, c’est la première vraie révolution Burkinabè.

Donc c’est avec hésitation et angoisse que plusieurs Burkinabè attendent la suite des actions courageuses de la semaine du 31 octobre, et les années de manifestations, marches, plannings, et meetings qui ont précédé la semaine de crise. Une grande déception de voir Yacouba Zida, un responsable de l’RSP, garde présidentielle de Blaise Compaoré, prendre le pouvoir, même s’il se déclare avec cette mouvement civile. S’il est vraiment avec eux, qu’il applique les principes d’une transparence radicale. C’est cette transparence qui sera le seul garant d’une révolution transformatrice. Oui, Zida pourra destituer les membres de l’ancien régime et satisfaire ainsi le sentiment naturel de justice. Oui, il pourra donner des postes importantes à Guy Hervé Kam et Augustin Loada, et ainsi satisfaire les liders d’une partie de la société civile. Oui, il pourra dialoguer pendant des mois avec Zépherin Diabré et Roch Mar Christian Kaboré. Mais, à la fin, tout dépendra de lui Zida, et sans transparence il pourra, et inévitablement il commencera, a manigancer, manipuler, se sentir sous certains pressions… et le grand jeu recommencera. Lamizana 3.0.  Une révolution devra mettre fin à ce jeu. Instituer un compromis social où l’alternance et la transparence devra être l’ordre du jour.

Alors, si Zida mérite la confiance de ceux qui se sont mis devant les chars de l’armée le 31 octobre, qu’il déclare que demain il va remettre le pouvoir à un conseil républicain provisionnel.

En plus, que les membres de ce conseil déclarent leurs biens. Et si lui-même sera membre de ce conseil, que lui aussi déclare ses biens.

Et en plus de cela, qu’il témoignage, sous serment et devant le publique, son rôle dans les évènements de l’ère Compaoré. S’il n’a rien fait, tant mieux. S’il a participé, ou avait connaissance des faits du décès de Norbert Zongo, Salifou Nebié, Clément Ouédraogo, guerre au Liberia, corruption au Darfour et au MONUSCO, collusion avec MNLA et MUJAO pour prises d’otages (comme le disent les uns et les autres), qu’il met ça à la lumière des caméras et smartphones. La vérité est la première pierre de toute maison politique.

Nous disons simplement que dans la situation actuelle, le peuple a une victoire d’étape et il veut rester maître de sa victoire. Quelque soit le type de transition que l’on peut faire, il est clair que cette transition doit se faire de manière consensuelle avec l’ensemble des forces de progrès et par lesquels les gens vont se reconnaitre
